(1) 赠与
指自愿地将自己的财产无偿转让他人的行为。因该种财产转让没有对价或补偿,故其区别于买卖或物物交易〔barter〕。它可以是生前赠与〔gift inter vivos〕,也可以是遗赠〔gift by will〕,而后者又分为不动产遗赠〔devise〕与动产遗赠〔bequest〕。赠与的本质要件一般包括赠与人的行为能力、赠与意图、已完全交付受赠人、受赠人接受赠与。如果赠与人〔donor〕尚未完成赠与,则衡平法不能使赠与完全生效。但通过将意图设定的受赠人〔donee〕指定为赠与人的遗嘱执行人,则可以使赠与生效。动产赠与在未经交付前并不发生财产转让的效力,除非该赠与系以契据方式作成。
